This case depends entirely on the construction of the Act of 1797, ch. 43, § 4, which has so long been a subject of legal controversy in this State. The great importance of the question, the serious consequences which seem to he apprehended from the decision of it in one way, as well as the respect due to the talents of those by whom the conflicting opinions are advocated, have induced me, notwithstanding the time which has heretofore been consumed in the discussion of the question, to consent to the very elaborate investigation which has occupied so much time at the present term.
