The defendant was convicted of driving while intoxicated, after a jury trial in the Court of Special Sessions of the Village of Brightwaters, and he now appeals. He claims three errors: 1. that although he was arraigned before Acting Police Justice William H. Westerbeke, his trial was presided over by Donald L.
