Appeal has been taken in this case from a final judgment dismissing a complaint which asked for a declaratory judgment and a money judgment.

The plaintiff Mutual Benefit Health & Accident Association, hereinafter referred to as the Association, is a Nebraska corporation engaged in the health and accident insurance business. The defendant United Casualty Company, hereinafter called the Company, is a Massachusetts corporation engaged in the same business.
