*370In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Queens County (Taylor, J.), dated November 14, 2002, which granted the motion of the defendant third-party plaintiff for summary judgment dismissing the complaint, granted the motion of the third-party defendant for summary judgment dismissing the complaint, and denied his cross motion for summary judgment on the issue of liability on the cause of action pursuant to Labor Law § 240 (1).
