CAFFREY, Senior District Judge.
Plaintiff, Elizabeth Dole, Secretary of Labor, United States Department of Labor, is charged with the responsibility of protecting the interests of participants in and beneficiaries of employee benefit plans, pursuant to the Employee Retirement Income Security Act of 1974 (“ERISA”). On October 29, 1987, in the United States District Court of the District of Massachusetts, the Secretary brought an action against John A.
