Judgment *988unanimously modified on the law and as modified affirmed and matter remitted to Cattaraugus County Court for resentencing in accordance with the following Memorandum: Defendant appeals from a judgment convicting him of rape in the second degree, incest, and two counts of sexual abuse in the third degree. We reject the contention of defendant that his conviction of rape and incest is not supported by legally sufficient evidence of penetration.
