The plaintiff in error, “ Nathan Holston, as administrator of the estate of Sam Holston, deceased,” brought an action for damages against the Southern Railway Company, basing his alleged right to recover upon certain statutes'’of the State of South Carolina, in which State the homicide of the plaintiff’s intestate ■occurred. It appeared upon the trial that the decedent, in company with two others, had been stealing a ride on the defendant’s passenger-train, he having gotten upon one of the trucks of the mail-car.
