In an action to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Supreme Court, Queens County (Lane, J.), entered October 23, 2009, which denied their motion, in effect, to restore the action to active status or for leave to file a new note of issue.

Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the plaintiffs’ motion which was, in effect, to restore the action to active status and substituting therefor a provision granting that branch of the motion; as so modified, the order is affirmed, with one…
