Reversing.

This action was instituted in the Fulton circuit court by the appellee, Dahnke-Walker Company, against the appellant, C. T. Bondurant, to recover damages' for the alleged breach of a contract, which the appellant and appellee had made, involving the sale and delivery of about fourteen thousand bushels of wheat, as estimated. After the pleadings had been made up, a trial followed before the court and a jury, and as a result the jury found a verdict in favor of the appellee and a judgment was rendered accordingly.
