Marvin Ohle and Richard Passow were jointly indicted in the criminal court of Cook County. The indictment consisted of three counts. In the first count, defendants were charged with robbing Adam Platak of ten dollars in money and a wallet of the same value, while armed with a dangerous weapon, specifically, a jack handle. Count two charged plain robbery and the third count charged an assault upon Platak with intent to kill. Defendants pleaded not guilty and waived a trial by jury.
