This is an application, on an order to show cause, for a writ of mandate involving the question whether or not certain language inserted by the legislature in the General Appropriations Act or “budget bill” of 1923 (Stats. 1923, p. 242), and vetoed by the Governor, is, nevertheless, effective upon the theory that the veto was nugatory. The petitioner is the state superintendent of public instruction and, as such, ex-officio director of education of the state.
