Appellant was convicted of the offense of murder in the second degree. His punishment was fixed at imprisonment in the penitentiary for the term of eighteen years. The deceased, one John O’Bryan, a deputy sheriff of Etowah county, attended night “preaching services” at a little country sehoolhouse.
