This matter comes before the board as an appeal by the Borough of Sayre from an order issued by the Department of Environmental Resources (DER) pursuant to the Pennsylvania Sewage Facilities Act of January 24, 1966, P.L. 1535, as amended, 35 P.S. §750.1 et seq. [Act 537], requiring appellant to amend its sewage plan to allow intervenor, David Henry, et ux, to install an on-lot sewage disposal system.
