In an action for a divorce and ancillary relief, the defendant husband appeals from an order of the Supreme Court, Nassau County (Yachnin, J.), dated August 9, 1989, which denied his motion to dismiss the action on the basis of res judicata, or, in the alternative, to dismiss the plaintiff wife’s cause of action for a divorce based on cruel and inhuman treatment on the ground of legal insufficiency.
Ordered that the order is modified, as a matter of discretion, by adding thereto a provision granting the defendant husband leave to renew that branch of his motion which was to dismiss the action…
