This is an action of assumpsit, brought by appellants composing the firm of Lamson Bros. & Co., against appellees composing the firm of Boyden & Co. The declaration contains the common counts only, and recovery is sought under the count for money had and received. In the trial court the cause was tried by agreement before the judge without a jury. The only evidence introduced was that of the plaintiffs; the defendants offered no proof.
