KiMball, Justice.

This action was commenced before a justice of the peace. The judgment of the justice was in favor of the defendant, and the plaintiffs appealed to the district court. On a trial da novo in the district court the judgment was for the plaintiffs, and the defendant brings the case here on error. The sole contention is that the district court did not acquire jurisdiction of the defendant.

There is no claim that the appeal from the justice court to the district court was not properly and regularly perfected. The transcript and papers were received and filed and the appeal docketed…
