The above are separate suits, but, as the questions in each are identical and as they were tried together in the district court, we shall consider them as one.
The defendant, S. J. Rockhold, is, it seems, a contractor and builder. He owned a tract of land situated partly within and partly without the corporate limits of Jonesboro, Jackson parish, which tract he subdivided into lots.
