delivered the opinion of the court.

The question which we have to consider is this:

Was Bronson bound by law to accept from Rodes United States notes equal in nominal amount to the sum due him' as full performance aud satisfaction of a contract which stipulated for the payment' of that sum in gold and silver coin, lawful money of the United States ?

It is not pretended that any real payment and satisfaction of an obligation to pay fifteen hundred and seven coined dollars can be made by the tender of paper money worth in' the market only six hundred and seventy coined dollars.…
