— The appellee claims in his suit that-he contracted with appellant to make plans and specifications for the erection of two certain houses. It was a material issue in the trial of. the case as to the condition in the agreement for the pay for the plans and specifications. Appellee contended that the plans and specifications were ordered to be drawn on the basis of the cost of material and construction to be $3,000 for each building.
