The defendant Franey was legally elected collector of taxes for the city of Hartford for the term of two years from April 6th, 1874, and on April 5th, 1876, was re-elected for a term of like duration. He accepted, and continued in the exercise of the duties of that office from the date of his first election until July 12th, 1877, when he resigned.
