Plaintiff in error was convicted at the January, 1910, term of the county court of Murray count}'- on a charge of having in his possession intoxicating liquor for the unlawful purpose of selling the same, and his punishment fixed at a fine of $100 and imprisonment in the county jail for a period of 30 days. When the case came on for trial, he filed a motion for continuance on the ground that a certain witness, Dr. Sullivan, was absent from the state.
