From Grant Circuit Court; H. J. Paulus, Judge. Action by the State of Indiana, on the relation of Florence Gordon and another, against Paul Price. From the judgment rendered, the defendant, by his next friend, appeals.

The relatrix Florence Gordon, on April 16, 1915, filed an affidavit against the appellant, in which she alleged that she was pregnant with a bastard child. At a later date the relatrix was examined by the justice of the peace before whom the affidavit was filed and her examination shows that she had been delivered of a bastard child about the last of April, 1915, and that appellant was the father of her child. The findings of the justice of the peace show the same facts, and the case was duly certified to the Grant Circuit Court on June 21, 1915. On October *312, 1915, the circuit court…
