OPINION AND ORDER

I. PRELIMINARY STATEMENT.

This case presents the question of whether an international union can expel from its ranks a local affiliate, whose membership is predominantly black, because the local refuses to accede to an order by the International requiring it to merge with another local whose membership is almost totally white, so as to eliminate the vestige's of dual unionism based upon race in a particular geographical area. The term “dual unionism” refers to the existence of two local unions with identical terriitorial and work jurisdiction.…
