This case was before the court for determination at a previous term. It will be found fully reported in 56 Tex., 574. The facts to be considered in deciding the present appeal are as follows:
On the 16th of August, 1880, the appellant Carrie Lowell, as the widow of H. Lowell, for herself and her minor children, filed her application in the county court of Galveston county for an allowance in lieu of homestead and other exempted articles, alleging that *565they did not exist in kind in the estate, and also for one year’s support for herself and her children.
