_JjMichael Shannon (“Shannon”), the defendant, was initially charged by a bill of information filed on 14 July 2005 with manslaughter. On 28 July 2005, he was indicted for the second degree murder of Ralph Cole under case number 461-701. On 21 September 2006, the trial court denied Shannon’s motion to suppress the identification. On 7 June 2008, the state entered a nolle prosequi after its motion to continue the trial was denied.
