The appellee, Joseph Daube, brought suit in the municipal court of Chicago against appellants for salary and commission alleged to be due him for the sale of merchandise. The trial court at a certain stage in the proceedings allowed a non-suit to be taken by appellee and the suit was dismissed at appellee’s cost. Thereafter appellants moved to vacate the judgment, which motion was denied. Appellants took the case to the Appellate Court by writ of error, where the judgment of the municipal court was affirmed.
