*1399Appeal from an order of the Supreme Court, Erie County (Joseph R. Glownia, J.), entered October 30, 2008 in a personal injury action. The order granted the motion of plaintiff for partial summary judgment on liability.
It is hereby ordered that the order so appealed from is unanimously reversed on the law without costs and the motion is denied.
