On exceptions to the acceptance of reports of a referee. The first action is brought by Depositors *144Trust Company in its capacity as trustee under the will of Joseph M. Cloutier, (hereinafter called the vendor) against Eichard E. Bruneau and Maurice H. Drew (hereinafter called the vendees) to recover damages for the breach of a contract to purchase certain real estate.
