Defendant in error recovered judgment against Annie Mayott, one of the plaintiffs in error, in a justice of the peace court in Daramie County. Mayott appealed to the district court and gave an undertaking on appeal in the usual form, with Idelman, the other plaintiff in error, as surety. Thereafter the case was docketed and set for trial in the district court, after which Mayott attempted to dismiss her said appeal by an entry upon the docket.
