In this case the appellee, Bryan H. Tivnen, sued J. 0. Gebhart, the appellant, in the circuit court of Macon county to recover $1,035, the balance claimed to be due from the appellant for rent of a storeroom situated in the City of Mattoon. The pleading in the case consists of a declaration of one count, setting forth the basis of the appellee’s right to recover under an alleged leasing of the premises; and an additional count filed by leave of court.
