This suit was brought by appellee to recover from appellant the value of a dwelling house and its contents which were destroyed by fire in the city of Greenville on the 13th day of August, 1907. The petition alleged that in 1888 the city of Greenville, by ordinance, entered into a contract with King and others and their assigns giving them the right to construct, maintain and operate in said city a complete system of waterworks for an adequate supply of water to said city and its inhabitants for domestic and manufacturing purposes and for the extinguishment of…
