Appeal from surrogate’s court, Kings county. Judicial settlement of the accounts of John F. James and James-Campbell, as executors of the will of Mary Ann Harvey, deceased. From a decree directing distribution of the estate, Francis M. Potter-appeals. Reversed.

This is an appeal from the decree of the surrogate of Kings county directing the distribution of the estate of Mary Ann Harvey, deceased. By the last will and testament of the testatrix, she first gives to nine persons legacies amounting in the aggregate to the sum of $4,000. Then follow these provisions:
“I have two thousand four hundred dollars in the Metropolitan Gas-Light Company, Brooklyn. One thousand dollars 1o go to my niece Lizzie Lawback, *2of New York, and one thousand dollars to her sister, Mary Ann Kearns, of ■Chicago, Illinois; four hundred dollars to their brother, John A.…
