The plaintiff, Commercial Wharf East Condominium Association (Association), commenced this action in the Land Court seeking damages, relief in the nature of a writ of entry, declaratory relief, and injunctive relief. The Association claimed that the right to manage the Association’s parking area, which right was reserved by the defendant Blue Water Trust (developer) and subsequently conveyed to other defendants, was invalid.
