On March 5, 1907, Maggie Mulligan filed her petition in this action seeking to have set aside a decree of divorce obtained against her by her husband, the defendant, at a former term of the court of common pleas.'

In her amended petition, subsequently filed, she alleges,that that decree was obtained by fraud and perjury, in this, that her husband was not, at the time of filing his petition for divorce, a tona fide resident of Mercer county, and had not been a resident of the state for, one year prior to the filing of his petition; that she had no actual notice of such action in time to malte…
