¶ 1 Appellant, James V. Lewis (Lewis), appeals, and Respondent, B & B Pawnbrokers, Inc. (B&B), cross-appeals from the order of the District Court of the Eighth Judicial District, Cascade County. This case originated with a claim filed by Lewis with the Montana Department of Labor and Industry (the Department) for unpaid overtimé compensation from B&B. The District Court ultimately dismissed Lewis’ claim on the ground that he was estopped from raising the claim as a *84result of failing to notify his employer, B&B, prior to filing his claim, that he was legally entitled to unpaid overtime wages.…
