OPINION
BEVILACQUA, Chief Justice.
The defendants, Paul J. Gazerro and Scott T. Badessa, were indicted on March 19, 1976, for the murder of Robert M. De-mirjian, in violation of G.L.1956 (1969 Reenactment) § 11 -23-1, and for conspiracy to murder, in violation of G.L.1956 (1969 Reenactment) § 11-1-1. After a trial in the Superior Court, a jury acquitted both defendants of the conspiracy charge but found them both guilty of murder in the second degree.
