DECISION AND ORDER
DAVID G. LARIMER, District Judge.
Plaintiff William J. Murray, appearing pro se, commenced this action in August 2008 against New York State and the New York State Department of Correctional Services (“DOCS”), under 42 U.S.C. § 1983. Plaintiff, who has been employed by DOCS since 1997 and is currently employed as a substance abuse counselor at Five Points Correctional Facility, alleges that he has been subjected to various forms of harassment and adverse employment actions in retaliation for plaintiffs having reported acts of fraud by DOCS officials.
