Appeal from an order of the Supreme Court (Kavanagh, J.), entered June 14, 2002 in Ulster County, which denied defendant’s motion for summary judgment dismissing the complaint.
In August 1997, during a family vacation at defendant’s ranch resort, plaintiff Rosemarie Connor (hereinafter plaintiff) was injured when she fell from the “Banana Boat,” a ride operated by defendant. The ride consists of two inflatable pontoon-style boats which passengers straddle, and which are towed by a motorboat on defendant’s lake.
