Order unanimously affirmed with costs. Memorandum: Following termination of a personal injury action, two separate actions were commenced involving insurance coverage for the defendants. Public Service Truck Renting, Inc. commenced an action in Queens County and subsequently, Merchants Mutual Insurance Company commenced an action in Erie County.
