Appellee, an infant, by her father, as next friend, sued appellant for damages for personal injuries alleged to have been inflicted by appellant in negligently propelling one of its cars upon appellee while she was crossing its tracks in Denison, Tex., so injuring one of her legs as to necessitate amputation. The negligence alleged was in propelling the car which injured appellee at an excessive rate of speed and in failing to exercise care in looking out for persons about to cross its track, especially children, and in failing to exercise ordinary care to avoid the injury after discovering…
