NORTHCOTT, Circuit Judge.

This is an appeal from a decree entered in the District Court of the United States for the Eastern District of Virginia, in a suit in equity which the appellant, herein referred to as the plaintiff, brought in said court, in May, 1935.

The suit was brought under section 5259 of tthe Code of Virginia and its object was to have the will of one William R. Hayes, under which will the appellee, herein referred to as the defendant, was the sole beneficiary, declared not to be the last will and testament of the said William R.
