I. Background
On or about May 3, 2001, Anthony Pitter (“Pitter” or “Petitioner”) filed a pro se petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 (“Petition”), challenging his March 5, 1997 conviction in Supreme Court, New York County, for criminal sale of a controlled substance in the third degree (New York Penal Law § 220.39[1]). Pitter’s conviction was affirmed on February 22, 2000 by the Appellate Division, First Judicial Department, People v. Pitter, 269 A.D.2d 287, 704 N.Y.S.2d 456 (1st Dep’t 2000).
