Muncy Creek Township Citizens Committee (appellant) appeals an order of the Court of Common Pleas of Lycom ing County which sustained the preliminary objections of Robert Shipman and David Rupert (appellees) and dismissed the appellant’s complaint seeking to remove appellees from office.

Appellant filed a complaint on March 14, 1988, pursuant to Section 503 of The Second Class Township Code (Code), Act of May 1, 1933, P.L. 103, as amended, 53 P.S. § 65503, seeking to remove the appellees as supervisors of Muncy Creek Township for failure to perform their elected duties.…
