Foster, J.—
In this case the plaintiff, a traveling salesman, checked his baggage for Milwaukee on Sunday, October 6, 1907, over the defendant’s road, but one of his trunks, which was then in Chicago and in the defendant’s possession, was not forwarded until Thursday, October 10, when pursuant to instructions it was sent to Appleton, but did not arrive there until after the plaintiff had left, and he first saw it on hisi return through Appleton on Friday, October 11.
