This is a suit upon a fire insurance policy for $3,200. The contract of insurance was written in the name of Hugh Ritchie, the owner of the property. While the contract was in force, Ritchie executed a mortgage upon the property in favor of Schill for $3,200, and gave Schill his promissory note, properly identified with the act of mortgage, for that amount. About two months thereafter the defendant company attached a rider to the insurance policy containing a mortgage clause with full contribution payable to Ellie H. Schill.
