delivered tbe following opinion:

This matter comes up upon a motion to retax tbe costs, mainly relating to witnesses, in tbe bill as allowed by tbe clerk. As I understand it, tbe objection is not so much to tbe items as to tbe fact that tbe bill is not sworn to at tbe proper time, witbin tbe ten days as set out in tbe local statute. Altbougb tbe amount is small, it seems tbe point bas not been raised before in this court, and it is well to decide it.
