OPINION AND ORDER

PERRY, District Judge.

This is an action against the United States for damages under the Federal Tort Claims Act, 28 U.S.C. § 1346(b). The plaintiff, a South Carolina resident, alleges that on November 11, 1980, while lawfully on the premises of Moncrief Army Hospital at Fort Jackson, South Carolina, he was assaulted, kicked, subjected to violence and placed under arrest by United States Army Military Police, all without justification. He seeks recovery of damages upon two causes of action, (1) false arrest, and (2) assault and battery.
