FINDING OF FACTS:

In July, 1956, the defendant Members of the Board of Township Trustees of Green Township, Summit County, Ohio, served on the plaintiff, Robert J. Boettler, a notice to stop casting water from a pond on his land, located in the southwest quarter of section 35 in Green Township, onto Mt. Pleasant Road, known as County Highway No. 7, which is the road along the line dividing Summit and Stark Counties in the vicinity.
