Plaintiff appeals from a judgment rejecting a demand for damages for *225tile value of a ginhouse, cotton, etc., destroyed by fire alleged to have been set out by sparks from a locomotive of the defendant company.
The fire was discovered at about 4:20 a. m., after it had gained considerable headway. It had started on or in that end of the 'gin- ■ house nearest the railroad track, which was about 70 feet away. There is no direct evidence of the origin of the fire. Plaintiff’s allegation that it was started by sparks from a locomotive is based upon the circumstance that a passenger train had passed…
