Thomas Moran was seriously injured by a rock falling upon him while at work in a coal mine operated by the Chicago, Wilmington and Vermillion Coal CompanjL He brought this suit against the coal company to recover damages for said injury. His declaration consisted of an original and four additional counts, or five in all. The first, second and third were for common law negligence, the fourth for a willful violation or neglect of a statutory duty in failing to furnish props, and the fifth for a willful violation or neglect of a…
